Ministerie van Buitenlandse Zaken weigert brief aan te nemen van Soedanese vluchtelingen

Vandaag deden zo’n 20 mensen mee aan een protestactie in Den Haag tegen het Soedanese militaire bewind en tegen het beleid van de IND. Na afloop zou een brief worden overhandigd aan iemand van het ministerie van Buitenlandse Zaken.

Op 5 december vorig jaar heeft het Soedanese militaire regime een akkoord gesloten met een deel van de oppositie. Er is afgesproken dat het leger zich gaat terugtrekken uit de regering. Maar een aantal politieke partijen, de verzetscomités en de vakbonden weigeren om mee te doen met deze zogeheten “raamovereenkomst”. De breed gedragen protestbeweging van onderop vertrouwt de deal niet en komt daartegen in actie. Niet alleen in Soedan, maar ook in Nederland.

Het protest begon bij de Koekamp, waar een aantal speeches werd gehouden. Aan het woord kwamen onder andere Khalid van We Are Here en Haitham. Die vertelde over de raamovereenkomst, het wantrouwen van onderop, ook gezien het buitensporige geweld in reactie op protesten tegen de coup, en de illegale pushbacks van vluchtelingen die Europa trachten te bereiken. Saada ging daar in haar toespraak verder op in. Ze maakte duidelijk dat Soedan niet veilig is. Door het vertragen van onze asielprocedures is men ons langzaam aan het doden, zei ze ook. En alle vluchtelingen moeten verblijfsrecht krijgen, want geen mens is illegaal.

Daarna wilden we gezamenlijk naar het ministerie lopen, maar dat vond de aanwezige politie geen goed idee. Het zal weer eens niet. Maar we deden het toch. Want hoezo kan je niet met twintig mensen door Den Haag lopen? Bij het ministerie werd de brief, die is opgesteld door een reeks Soedanese organisaties, nog snel even getekend door een aantal van de aanwezige vertegenwoordigers daarvan.

Helaas kwam er niemand van het ministerie naar buiten om de brief aan te nemen. Een maand geleden hadden de organisaties al per mail aangekondigd dat men de brief wilde komen overhandigen, maar daar is nooit een antwoord op gekomen. Naar binnen mogen we ook niet. Een aanwezige agent wilde hem binnen gaan afleveren, maar dat mocht niet. Daarna ging hij met een aantal van de vertegenwoordigers naar de postafdeling om hem daar in te leveren. Maar ook dat werd niet toegestaan. Zelfs de agent was enigszins verbijsterd.

Inmiddels waren er meer agenten gearriveerd, voor het geval de horkerigheid van het ministerie tot irritatie zou leiden? Voor de ingang werd nog eens uitgebreid uitgelegd wat er in de brief stond en hoe belachelijk het ministerie reageerde op gewoon een brief! Daarna zijn we naar een postagentschap gegaan om de brief dan maar aangetekend te versturen.

Hieronder nog de integrale tekst van de brief die het ministerie maar niet in ontvangst wil nemen.

Dear Minister. We write this memorandum to you based on our conviction that the framework agreement between the Forces of Freedom and Change and the military establishment in Sudan does not represent a positive step, as the optimists chant, on the way to terminate the military’s domination of power, nor does it represent the hope that human rights defenders all over the world long for to end the plight of Sudanese asylum seekers in your esteemed country. We consider the framework agreement a violation of the goals of the glorious December Revolution represented in removing the military from power, forming a purely civilian government to which all authorities are subject, handing over power completely to civilians, dissolving the notorious Rapid Support Forces militia, launch an international investigation into the events of the massacre of the General Command, bringing the perpetrators to trial, handing over the wanted persons to the International Criminal Court and holding the corrupt accountable.

We believe the dilemma of the transitional period lies in the existence of multiple heads of power and decision-making centres. In addition, extending the transitional period to the next two years carries a great risk, as the de facto authority is neither elected nor decentralized and is unable to take decisive decisions.

In this context, the signatories have delivered a memorandum to the Sudanese regime’s embassy in the Netherlands on December 19th, 2022, denouncing the framework agreement, and considering it a mere ploy by the army to mitigate critical voices and inner indignation. The signatories are truly dismayed by the haste of Western countries that claim to defend human rights to welcome the framework agreement between the Forces of Freedom and Change and the military component, despite the latter’s shameful record of repression, gagging mouths and violations that humanity condemns.

We are also appalled that other Western countries were giving assistance to the Rapid Support Forces militia, ignoring the fact that these forces are accused of committing egregious abuses of the very human rights the countries concerned claim to defend. According to Amnesty International, the transitional government’s modest progress towards improving the human rights situation “suffered a major setback after the October 2021 military coup.” Amnesty says, “Security forces used excessive and even lethal force and other repressive measures, including reported cases of gender-based violence, to counter protests and opposition to the takeover”, pointing out that “at least 53 people were killed, and hundreds injured in demonstrations following the coup.” Amnesty International also states that “the military authorities used prolonged arbitrary detention, arresting dozens of civilian political leaders and activists, holding them in incommunicado detention”, stressing that “previous promises to investigate and prosecute crimes committed by security forces remained unfulfilled.”

It is worth mentioning here that a German ngo submitted a criminal complaint at the International Criminal Court against high-profile European politicians. The European Centre for Constitutional and Human Rights (ECCHR) accuses the politicians, including the EU’s former foreign policy chief Federica Mogherini, Italy’s current and former interior ministers and the current and former prime ministers of Malta, of “committing several crimes against humanity in the form of the severe deprivation of physical liberty between 2018 and 2021 by systematically intercepting boats in the Mediterranean and sending refugees back into detention in Libya”.

The German ngo alleges that the high-profile European politicians “conspired with Libya’s coastguard to illegally push back refugees trying to cross the Mediterranean Sea into Europe”. We are considering submitting a similar complaint before the International Criminal Court in cooperation with non-governmental organisations defending human rights, within the framework of the steps we have taken in defence of Sudanese political opponents in the Netherlands. We are also considering submitting a complaint to the special procedures of the Human Rights Council (HRC), beside delivering oral statements, and conducting a side event in one of the upcoming sessions of the Council.

We hereby strongly appeal to your esteemed administration to take the necessary measures to end the plight of Sudanese asylum seekers and to their long suffering, and to prove that the Netherlands is at the forefront of sponsoring countries for refugees fleeing repression and persecution in their country in search of safe havens.
